ELECTRONIC DISCLOSURE CONSENT

This Electronic Disclosure Consent (“Consent”) applies to all communications and required disclosures relating to your Fort Knox account. The words “we,” “us,” and “our” refer to Austin Capital Bank.  The words “you” and “your” mean you, the individual(s) identified on the Agreement.  As used in this Consent, “Account”means the Fort Knox account you have with us.

To the greatest extent not prohibited by law, you consent and agree that we may provide (i) this Consent, (ii) your Fort Knox account, and (iii) all other ancillary agreements, privacy policies and notices, and all other legal and regulatory disclosures required by law (collectively, “Communications”) related to your Fort Knox Agreement and Account to you in electronic form.  You should print or download for your records a copy of this Consent and any other Communication that is important to you that is provided to you in electronic form.  All Communications in either electronic or paper format from us to you will be considered “in writing.”  All Communications that we provide to you in electronic form will be delivered to the email address that you provide to us or provided through your Fort Knox customer account center.  It is your responsibility to provide us with accurate and complete e‐mail address and contact information, and to maintain and update promptly any changes in this information.  You can update this information (such as a new e‐mail address) by signing into your Portal, calling (308) 258-5980 or writing to Austin Capital Bank, Attn: Fort Knox, 8100 Shoal Creek Blvd., Austin, TX 78757.  You can obtain a paper copy of an electronic Communication by requesting that we mail you a paper copy, provided that such request is made within a reasonable time after we first provide the electronic Communication to you.  To request a paper copy, write to us at Austin Capital Bank, Attn: Fort Knox, 8100 Shoal Creek Blvd., Austin, TX 78757 or email us at [email protected].  We will not charge you a service charge for the delivery of paper copies of certain Communications. 

Text Message (SMS) Service: You acknowledge and agree you may receive periodic text messages. These messages may include account alerts, transaction notifications, and important updates regarding your banking services. You may opt out of receiving text messages at any time. To opt out of the FortKnox.bank text message program, send a text message with the word “STOP” to 911007 from your mobile device. If you need help with the text message service, please contact us at [email protected] or text “HELP” to 911007.

Message and data rates may apply to all text messages sent to or received from us. For more information regarding these rates, please review your mobile service plan or contact your mobile carrier. Carriers are not liable for delayed or undelivered messages.

You may withdraw your consent to receive Communications in electronic form at any time without being charged a fee by calling (308) 258-5980, emailing us at [email protected], or writing to Austin Capital Bank, Attn: Fort Knox 8100 Shoal Creek Blvd., Austin, TX 78757. If you withdraw your consent, we will terminate our relationship. Withdrawal of your consent will be effective only after we have had a reasonable period of time to process your withdrawal. In the meantime, you will continue to receive Communications in electronic form. If you withdraw your consent, the legal validity and enforceability of all prior Communications delivered in electronic form will not be affected.

You are providing your consent to receive electronic communications pursuant to the Electronic Signatures in Global and National Commerce Act, and you and we intend that the statute applies to the fullest extent possible.  Providing your electronic signature on agreements and documents has the same effect as if you signed them in ink.  To access, view and retain electronic Communications that we make available to you, you must have:

  • A device with access to the Internet;
  • A web browser that supports HTML and 128-bit encryption such as Chrome, Firefox, Edge or Safari;
  • The capability to download and print; and
  • either a printer, hard drive or other storage device.

We reserve the right to revise the hardware and software required to access, view and retain electronic Communications.  If there is a material risk that the changes may impact your ability to access, view and retain subsequent Communications, we will notify you of those changes 30 days in advance and provide you an opportunity to change your method of receiving Communications.

By (i) checking the box confirming you have read, understand and accept this Consent and (ii) clicking “Sign and Pay”, you (a) acknowledge that you have read this Consent and accepted all of its terms, (b) have an account with an internet service provider or mobile telephone company and (c) are electronically signing this Consent.  You also acknowledge your ability to view, download, or print a fully completed copy for your records.  Upon completion of the registration process, we will send you an email and ask you to confirm your email address and your ability to access electronic disclosures.
